SERVICE AGREEMENT AND POLICIES

User Responsibilities for Repair and Maintenance Services

Prior to service, it is your responsibility to back up important data from your computer on media other than your primary hard drive (i.e. CD's, DVD's, floppy disk, other hard drives).  If you are unable to do this because of malfunctions, or you do not know how to do this, we can assist you in this, but there maybe additional charges associated.  We can not be held responsible for lost or corrupted data because no usable back up was performed by the computer owner. 

In case of repair and maintenance service, the operating system disks (the disks that came with your computer) and other program disks may be needed.  In some situations, we may determine that the most affordable or best course of action may be to reload your operating system.  Please provide the operating system disks, other program disks, and the activation keys to those disks for drop off and on location service.  The activation keys are often a long combination of letters and numbers found on the CD or package the software came with.  For Windows Operating systems, this key is usual a sticker attached to the computer case.  Some software may not have these activation keys.

If on location services are to be performed, an adult (over 18 years old) must be present and must be authorized to make decisions regarding the serving of the computer. 

If on location services are to be performed and our technician finds that the requesting party is not available, an adult able to make decisions is not present, the operating system disks or other program installation disks are not present, or service can not be performed at the site due to environmental factors, hazards, or other factors, additional charges may apply and/or service may be refused.

Certain services or upgrades may require additional equipment.  We will try to provide that information to you prior to you service appointment, based on the information that you have given us about your problem.  However, after we begin servicing the computer, it may become apparent that there are other problems.

For Data Recovery Services

Some data may not be able to be recovered in the event of physical damage to the hard drive. 

Recovered data shall be on an "as is" basis without any warranties, express or implied.

Additional computer media expenses (hard drives, CD's, or DVD's) will apply.

For Investigative and Forensic Services

We may not be able to perform investigative services on some computers or devices for privacy reasons.  We will disclose any issues with you during consultation.  You must have the lawful right to access or give consent for a computer to be analyzed.  Additional computer media expenses  (hard drives, CD's, and DVD's) will apply.

For All Services

In no event, shall Confidential Computers LLC be liable to customer for any special, indirect, incidental, consequential or punitive damages, including, without limitation, loss of profits, revenues or goodwill, however, caused whether for breach of contract, negligence or otherwise, and whether or not Confidential Computers LLC has been advised of the possibility thereof.  This limitation shall apply notwithstanding any failure of essential purpose of any limited remedy provided herein. 

Confidential Computers LLC shall be held harmless from and against any loss, liability, or damage that you may suffer, including but not limited to any loss of any data and the non-functioning of any component or element of your computer equipment or peripherals resulting from Confidential Computers LLC service, regardless of the warranties, disclaimers and waivers of a particular service.  Confidential Computers LLC shall not be liable to customer for any act or omission which is the cause of loss or injury to customer or third party.

Although we keep your data confidential and will not share your information with anyone, we will report child pornography to law enforcement.
